These terms govern your use of the Colorado Day BAZAAR website and its online forms. By using the site, you agree to these terms.
Effective and last updated: July 23, 2026
Site operator: TBW Enterprises LLC operates this site and the Gum Pop Presents event pages. Our mailing address is PO Box 3128, Greenwood Village, CO 80155. Contact contact@gumpoppresents.com or (720) 445-6381.
1. Using the site
You may use this site for personal, informational, and legitimate business inquiry purposes. You may not:
Break the law, violate another person's rights, impersonate someone, or submit false or misleading information.
Interfere with the site, attempt unauthorized access, introduce malicious code, scrape the site in a way that burdens our systems, or bypass security measures.
Use site content or contact information for spam, unlawful marketing, or automated solicitation.
We may restrict access or reject a submission when reasonably necessary to protect the site, our events, or other people.
2. Event information can change
We work to keep event dates, times, locations, lineups, makers, schedules, offers, accessibility information, and other details accurate. Outdoor events and live programs can change because of weather, safety, permitting, artist or maker availability, partner decisions, or circumstances outside our control. Check the event page and official day-of channels before traveling.
Unless a separate written policy says otherwise, site content is informational and is not a guarantee that a particular maker, performer, product, offer, reservation time, or experience will be available.
3. Forms, reservations, and communications
You are responsible for providing accurate information and keeping your contact details current. A form confirmation shows that we received your submission. It does not create a contract for admission, employment, sponsorship, booth placement, inventory, or a guaranteed experience unless we expressly confirm that commitment in writing.
Reservation and volunteer capacity may be limited. We may contact you about scheduling, event operations, safety, changes, or follow-up related to your request. Marketing email is optional, and you may unsubscribe at any time.
Our handling of personal information is described in the Privacy Policy.
4. Admission, purchases, and third parties
Colorado Day BAZAAR is advertised as a free public event. Purchases from makers, food providers, sponsors, or other participants are separate transactions between you and that party. Their prices, payment terms, refunds, product claims, and warranties are their responsibility unless TBW Enterprises LLC expressly identifies itself as the seller.
5. Site content and trademarks
The site design, writing, graphics, logos, photos, video, and other content are owned by TBW Enterprises LLC or used with permission. You may view and share links to public pages for personal or editorial reference. You may not reproduce, sell, modify, or commercially exploit protected content without permission, except as allowed by law or expressly offered in the press kit.
Names and marks belonging to makers, performers, sponsors, and other partners remain the property of their respective owners.
6. Information you submit
You keep ownership of content you submit. You give us permission to use, store, route, and reproduce that content only as reasonably necessary to respond, evaluate the request, operate the event, keep records, and protect our rights. Do not send confidential material unless we have agreed in writing to receive it confidentially.
7. Third-party links and services
The site links to maps, transit, social media, ticketing, calendars, makers, performers, sponsors, and other third parties. We do not control their services, availability, security, content, or privacy practices. Your use of a third-party service is governed by that party's terms and policies.
8. Disclaimers
To the fullest extent permitted by law, the site and its content are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise uninterrupted access or that every error will be corrected. Nothing in these terms excludes a warranty or right that cannot legally be excluded.
9. Limitation of liability
To the fullest extent permitted by law, TBW Enterprises LLC and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the site or your reliance on its content. Our total liability for a claim arising solely from use of this free site will not exceed one hundred U.S. dollars. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
10. Your responsibility
To the extent permitted by law, you agree to defend and indemnify TBW Enterprises LLC from claims, losses, and reasonable costs arising from your unlawful misuse of the site, your violation of these terms, or your infringement of another person's rights.
11. Governing law and changes
Colorado law governs these terms, without regard to conflict-of-law principles. Any dispute will be brought in a state or federal court with jurisdiction in Colorado, unless applicable law requires otherwise.
We may update these terms. The date at the top shows the latest revision. Continued use after an update means the revised terms apply from their effective date. If one provision is unenforceable, the remaining provisions continue in effect. These terms and any specific written terms for a service are the entire agreement about use of this site.
